Article 1: License Grant. The content of the courseware on this site is the intellectual
property of Training on Demand, LLC (ECTOD) and its licensors, and is protected by law,
including United States copyright laws and international treaties. ECTOD grants to you a
license:

WHOLE OR PART.
Article 2: Term: The license is effective until terminated. You may terminate the license at
any time by destroying the courseware together with all copies, modifications, and merged
portions in any form. The license will also terminate upon conditions set forth elsewhere in
this Agreement, and ECTOD may terminate your license if you fail to comply with this
Agreement. You agree, upon such termination for any reason, to destroy the courseware
together with all copies, modifications, and merged portions in any form.
Article 3: Disclaimer of Warranties and Limitations of Remedies
1. ECTOD’s courses are licensed to you As Is. You, the consumer, bear the entire risk
relating to the quality and performance of the software and its contents. In no event will
MB&A be liable for direct, indirect, incidental, or consequential damages resulting from any
defect in the software or misuse of its content, even if ECTOD had reason to know of the
possibility of such damage. In the event any liability is imposed on ECTOD, ECTOD’s
liability to you or any third party shall not exceed the purchase price paid for the course(s).
2. While ECTOD has used its best efforts in preparing the courseware on this site, ECTOD
makes no representations or warranties with respect to the accuracy or completeness of the
contents of this courseware and specially disclaims any implied warranties of merchantability
or fitness for a particular purpose. No warranty may be created or extended by any ECTOD
representative or written ECTOD materials. The advice and strategies contained in the
courseware may not be suitable for your situation. ECTOD is not engaged in rendering
professional or consulting services with regard to your particular situation, and you should
consult a professional where appropriate. Neither ECTOD nor the course developers shall

transfer any of the rights, duties, or obligations hereunder is void.
2. This Agreement will be governed by the laws of the State of Georgia, and you agree that
any claims regarding the software and its contents shall be brought in Georgia, and waive
any objections to jurisdiction in the U.S. District Court for the Northern District of Georgia or
the Georgia Superior Court in Fulton County.
3. You acknowledge that U.S. laws prohibit the export-re-export of technical data of U.S.
origin, including software, and agree that you will not export or re-export the software without
the appropriate U.S. and foreign government license.
